Does Lake Havasu Offer Home Detention For DUI?

Lake Havasu courts are unlike any other courts in Arizona. As a criminal defense lawyer, it's frustrating that courts apply DUI sentencing laws differently. For example, an outcome of a Phoenix DUI is very different than an outcome of a Lake Havasu DUI.  More importantly, as it relates to clients visiting Lake Havasu from California, Lake Havasu is extremely different than California.  Anytime I'm providing a DUI consultation (which by the way are always free), I'll always tell them that if they think they are going to get a slap on the wrist, or what they refer to as "wet reckless," it's not going to be that easy. The truth is, the only way to get a good result for a DUI out of Lake Havasu is to fight the case to the fullest extent possible.  Telling the judge or the prosecutor that our client is the bet person in the world, never been in trouble with the law, etc., is not going to move the needle. From day one, we need to roll up our sleeves and look for a legal justification that we can use to your advantage.

So, let's get back to the subject of this blog post, Does Lake Havasu Offer Home Detention for a DUI?  Regretfully, the answer is no.  Although Arizona law allows judges to order home detention, it's discretionary. No matter how much a lawyer or person pleads with the Lake Havasu judges, home detention will not be an option.  Another big warning, if you call around to speak with an attorney and they say they may be able to negotiate home detention, hang up immediately. They have no clue what they're talking about and have probably never handled a DUI case out of Lake Havasu.

Without the possibility of home detention, if you're convicted of a DUI, you are looking at serious jail time.  If you're blood alcohol content was over a .15, you could be facing 30 days in jail, if you're blood alcohol content was greater than .20, you could be facing 45 days jail, even worse, if this is your second DUI in 7 years, you could be facing up to 180 days.  Although Havasu does not offer home detention, it's not doom and gloom.
