Arizona Assault Laws
Arizona law defines assault under A.R.S 13-1203. According to the law, a person commits assault by intentionally knowingly or recklessly causing harm or injury to another; or placing a person in reasonable fear of imminent harm or injury. In either circumstance, Assault is class 1 misdemeanor, punishable by jail, fines and counseling.
This is a charge that carries a stigma. If you're convicted of assault, people who conduct your background check will automatically make assumptions. Our attorneys are very good at demonstrating why this charge was a misunderstanding or self defense. We will do whatever it takes to prevent you from having a criminal conviction on your record
Frequently Asked Questions About Assault Charges
Q: What happens at the first court appearance?
A: Your first court appearance is what's called a Not Guilty Arraignment. If you do not have a lawyer, you will have to attend this hearing. If you hire a lawyer, we can enter a Not Guilty plea without you having to attend.
Q: When will you receive the police report?
A: On the first day we are hired, we will submit a request for all evidence relating to your case - police report and video recordings. Lake Havasu usually takes 2-4 weeks to disclose the reports and videos
Q: What happens if I live out of State?
A: If you do not live in Lake Havasu, without a lawyer, you will have to make numerous in person court appearances. This will be a waste of your time and money. Our attorneys will try to resolve your case without you ever having to appear at court. At the very most, you will only have to make one appearance if you have a private attorney.
Q: Am I going to jail?
A: Lake Havasu is one of the toughest cities in Arizona when it comes to Assault charges. Depending on the set of facts, the prosecutor could be seeking jail time. Our attorneys have seen the prosecutor ask for up to 30 days in jail for some assault cases - even if the accused lives in another State. If you plan on representing yourself for an Assault charge at the Lake Havasu Court, you are making big mistake. You need a lawyer.
